Dear Victorian Labor Leadership,

I urge you not to proceed with the Justice Legislation Amendment (Police and Other Matters) Bill 2025. Peaceful protest is a fundamental principle of our democracy, and these new anti-protest laws threaten our communities ability to exercise our democratic rights.

Protest rights are under threat, with over 50 new anti-protest laws passed in Australia in the last 20 years, including 7 in Victoria. The reason given for the proposed bill is to protect public safety, but police already have all the powers they need to protect the community against criminal behaviour and violence. The proposed laws are too broad, creating a legitimate risk of criminalising community members trying to have their say, and chilling democratic participation.

I am especially concerned about:
- Police powers to order removal of facemasks at protests: This will unfairly impact people with a disability or health conditions, healthcare workers and carers, victim survivors of family violence, over-policed communities including LGBTIQ+ and multicultural people, and others with legitimate privacy or safety concerns. All people deserve to participate in protest in ways that protect their health, privacy and safety. 
- The new offence for ‘disrupting’ religious worship: while no one should face harassment while practicing their faith, this law is broad and ill-defined, risking inadvertently punishing protestors who just happen to be passing by a place of worship. 
- Prohibition on attachment devices: peaceful protest movements have long used glues, ropes, and locks in protest activities, including the now-celebrated protests for equal pay for women. Victorian police already have extensive powers to search and seize items and further restrictions are unnecessary.

Peaceful protests and community actions, including those using attachment devices, over the decades have helped win us civil and workers' rights, protection for the most vulnerable, and protection of our precious environment. Existing laws address violence and trespass, and these proposed laws do not address public safety as they profess to.

New laws to address violence and extremism should be specific and targeted – not undermine the safety of protestors and deter ordinary people from exercising their democratic rights.

Please ensure that this bill is stopped, or referred to an inquiry where proper community consultation can take place.
